DECISION & ORDER ON MOTION

Motion by Wesley Vaughn, in effect, pursuant to CPL 460.30 for an extension of time to take an appeal from so much of an order of the Supreme Court, Westchester County, entered January 10, 2013, as denied that branch of his motion which sought relief pursuant to CPL 440.46.

Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, it is
