2013-02680 DECISION & ORDER ON MOTION Ronald Michel, etc., appellant, v Long Island Jewish Medical Center, et al., respondents. (Index No. 24699/10)

Motion by the respondents, inter alia, to direct the appellant to serve and file a supplemental appendix on an appeal from an order of the Supreme Court, Queens County, entered January 28, 2013, and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to direct the appellant to serve and file a supplemental appendix is denied without prejudice to the respondents serving and filing their own appendix (see CPLR 5528); and it is further,
ORDERED that the branch of the motion which is to enlarge the respondent's time to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until March 18, 2014, and the respondents' brief must be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied.
