Motion by the petitioner for leave to reargue a proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Westchester County, dated February 23, 2012, which was determined by a decision and judgment of this Court dated September 18, 2013, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and judgment of this Court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with $100 costs.
