| DECISION & ORDER ON MOTION |
Motion by Sohrab Samimi for leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated October 16, 2013, and to stay a hearing on the issue of willfulness, pending hearing and determination of the appeal from the order and an appeal from a judgment of the same court entered August 21, 2013.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
