| DECISION & ORDER ON MOTION |
Motion by Richard Davidson to consolidate an appeal from a judgment of the Supreme Court, Nassau County, rendered July 2, 2013, with an appeal from an order of the same court dated July 9, 2013, for leave to file one brief for both appeals, and for poor person relief and the assignment of counsel with respect to the appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are to consolidate the appeals and for leave to file one brief for both appeals are denied; and it is further,
ORDERED that on the Court's own motion, the appeals will be calendared together and will be argued or submitted on the same day; and it is further,
ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel to prosecute the appeal from the order:

and it is further,
ORDERED that the branch of the motion which is for poor person relief and the assignment of counsel with respect to the appeal from the order is granted; and it is further,
ORDERED that on the Court's own motion, Richard Davidson s time to serve and file a brief in connection with the appeal from the order is is enlarged until March 18, 2014, and the brief must be served and filed on or before that date; and it is further,
ORDERED that on the Court's own motion, Richard Davidson s time to perfect the appeal from the judgment is enlarged; assigned counsel shall prosecute that appeal expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
