| DECISION & ORDER ON MOTION |
Motion by the appellant to reconstruct the record on an appeal from a judgment of the Supreme Court, Queens County, entered March 20, 2012, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to reconstruct the record is granted, and the matter is remitted to the Supreme Court, Queens County, to reconstruct the record in the above-entitled case; if the record cannot be reconstructed the Supreme Court shall issue a report to this Court with all convenient speed; and it is further,
ORDERED that the branch of the motion which is for a preference is denied without prejudice to renew after the record is reconstructed.
