| DECISION & ORDER ON MOTION |
Appeal by the defendant from an order of the Supreme Court, Queens County, dated July 25, 2013. By order to show cause dated September 19, 2013, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order was not appealable as of right and leave to appeal had not been granted.
Upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed (see CPL 450.10, 450.15), in light of the decision and order on motion of this Court dated January 9, 2014, denying the defendant's application for leave to appeal to this Court from the order dated July 25, 2013.
