DECISION & ORDER ON MOTION

Motion by Robert A. Bertsch for reconsideration of a three-year suspension imposed upon him by an opinion and order of this Court dated October 30, 2013, effective as of that date, so as to receive credit for the time served under a term of interim suspension. Mr. Bertsch was admitted to the Bar at a term of the Appellate Division in the Second Department on May 29, 1991. By decision and order on motion dated April 13, 2012, this Court immediately suspended Mr. Bertsch from the practice of law pursuant to Judiciary Law § 90(4)(f) as a result of his conviction of a "serious crime," continuing until further order of the Court, authorized the Grievance Committee for the Tenth Judicial District to institute and prosecute a disciplinary proceeding against Mr. Bertsch based upon his conviction of a "serious crime," within the meaning of Judiciary Law § 90(4)(d), and referred the issues raised by the petition, and any answer thereto, to the Honorable Georgia Tschiember, as Special Referee, to hear and report. By opinion and order of this Court dated October 30, 2013, Mr. Bertsch was suspended from the practice of law for a period of three years, commencing immediately, with no credit for the time served under the term of interim suspension.

Upon the papers filed in support of the motion and the papers filed in relation thereo, it is

ORDERED that the motion is denied.
