DECISION & ORDER ON APPLICATION

Application by the defendant pursuant to CPL 530.45 to be released on bail after his conviction of grand larceny in the second degree, in the Supreme Court, Kings County, upon a jury verdict, on June 24, 2013. The Supreme Court, Kings County, remanded the defendant pending the imposition of sentence.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application is granted, the defendant's bail is set by depositing the sum of $250,000 cash, and on condition that the defendant surrender any and all passports to the Office of the District Attorney of Kings County and refrain from applying for any new or replacement passports; and it is further,

ORDERED that this order shall terminate and be of no further effect upon the imposition of sentence or upon the defendant's failure to appear for sentence; and it is further,

ORDERED that upon receipt of a copy this decision and order on application together with proof that the defendant has deposited the sum of $250,000 cash, and proof that the defendant has surrendered his passport, if any, to the Office of the District Attorney, Kings County, the Warden of the facility at which the defendant is incarcerated, or his or her agent, is directed to immediately release the defendant; and it is further,

ORDERED that the Clerk of this Court, or her designee, shall serve a copy of this order, by mail, on the Clerk of the Supreme Court, Kings County.
