Appellant having moved to vacate dismissal of the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on February 22, 2013, and having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken from the order entered February 22, 2013,
Now, upon reading and filing the affidavits of Willie Singleton sworn to January 28, 2014, the notice of motion with proof of service thereof, and the affirmation of Harold A. Kurland, Esq., dated February 7, 2014, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of the appeal and seeks permission to proceed as a poor person is dismissed on the ground that the relief was already granted in this Court's order entered January 30, 2014, and the motion is otherwise denied.
