ORDER ON APPLICATION

Application by Keyspan Energy Corporation pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated May 10, 2013.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted; and it is further,

ORDERED that the Keyspan Energy Corporation's time to perfect its appeal is enlarged until March 12, 2014, and the joint record or appendix(see 22 NYCRR 670.8[c][1]) and the Keyspan Energy Corporation's brief must be served and filed on or before that date; and it is further,

ORDERED that Stephen D. Morales shall serve and file a brief, including his points of argument on his appeal with respect to Action No. 3 as well as points of argument on his cross appeal with respect to Action Nos. 1 and 5, in accordance with the rules of this Court (see 22 NYCRR 670.8[c][3]).
