DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Nassau County, dated July 9, 2013, on the ground that no appeal lies from an order denying reargument. Separate motion by the appellant for leave to file late opposition to the respondent's motion.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the appellant's motion is granted; and it is further,

ORDERED that the respondent's motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,

ORDERED that on the Court's own motion, the appellant's time to perfect the appeal is enlarged until April 25, 2014, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
