| DECISION & ORDER ON MOTION |
Motion by the respondent Kenneth L. Barnard to hold in abeyance a proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Suffolk County, dated September 4, 2012, pending determination of an appeal from an order of the United States Bankruptcy Court for the Eastern District of New York dated December 23, 2013, in an action entitled Matter of Schneider, under Case No. 804-85727-DTE.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the movant must notify this Court expeditiously, in writing, when the appeal from the bankruptcy court order is decided.
