| DECISION & ORDER ON MOTION |
Motion by the appellant to recall and vacate a decision and order on motion of this Court dated January 15, 2014, which dismissed an appeal from an order of the Supreme Court, Nassau County, dated June 27, 2013, for leave to appeal to this Court from the order dated June 27, 2013, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, the decision and order on motion of this Court dated January 15, 2014, is recalled and vacated, leave to appeal is granted, the appellant's time to perfect the appeal is enlarged until June 4, 2014, and the record on appeal and the appellant's brief must be served and filed on or before that date.
