DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Westchester County, dated November 1, 2012, for a reconstruction hearing with respect to the proceedings which occurred on June 19, 2009, and April 12, 2010, in the above-entitled action, to extend his time to serve and file a supplemental appendix, and for leave to include in the supplemental appendix the underlying motion papers concerning an order of the same court entered January 5, 2010, the order entered January 5, 2010, and the appellant's proposed findings of fact and conclusions of law, and proposed judgment of divorce.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the matter is referred to the Supreme Court, Westchester County, for a reconstruction hearing with respect to the proceedings which occurred on June 19, 2009, and April 12, 2010, in the above-entitled action, and the appellant shall immediately advise this Court when the reconstruction hearing is completed or if reconstruction cannot be accomplished; and it is further,

ORDERED that the appellant's time to serve and file the supplemental appendix is extended until April 7, 2014.
