Motion by the respondent on an appeal from a judgment of the Supreme Court, Kings County, dated June 20, 2013, to vacate any stay in effect pursuant to a rehabilitation and injunction order of the Court of Chancery of the State of Delaware dated November 7, 2013. Cross motion by the appellant to enlarge the time to perfect the appeal if the motion is granted.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied without prejudice to seeking relief in the Court of Chancery of the State of Delaware; and it is further,
ORDERED that the cross motion is denied as academic.
