Motion by Frank A. Lupino, as executor of the estate of Rose Lupino, to be substituted for the deceased respondent-appellant, Rose Lupino, on an appeal and cross appeal from a judgment of the Supreme Court, Nassau County, dated September 2, 2011, and to amend the caption accordingly.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
