| DECISION & ORDER ON MOTION |
Motion by Hudson One, Inc., on an appeal and cross appeal from an order of the Supreme Court, Rockland County, dated July 10, 2012, and an appeal from an order of the same court dated January 2, 2014, to dismiss the appeal and cross appeal from the order dated July 10, 2012, on the ground that the right of direct appeal from that order terminated upon entry of the order dated January 2, 2014. Cross motion by 5000, Inc., to hold the motion in abeyance pending determination of its motion for leave to renew and reargue the motion and cross motion that resulted in the order dated January 2, 2014.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition or in relation thereto, it is
ORDERED that the motion and the cross motion are denied; and it is further,
ORDERED that on the Court's own motion the appeals shall be calendared together and argued or submitted on the same day.
