Motion by Westchester County Correction Superior Officers Association and others to enlarge the time to perfect their appeal from an order of the Supreme Court, Westchester County, entered March 21, 2013. Separate motion by County of Westchester and Westchester County Department of Correction to recall and vacate so much of a decision and order on motion of this Court, entitled "In the Matter of the Dismissal of Causes for Failure to Perfect - January 2014 Calendar", dated February 11, 2014, as dismissed their appeal from an order of the same court entered June 20, 2011, pursuant to 22 NYCRR 670.8(e) for failure to timely perfect, to reinstate their appeal, and to enlarge the time to perfect their appeal. Application by Westchester County Correction Superior Officers Association and others to consolidate the appeals.
Upon the papers filed in support of the motions and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motions are granted; and it is further,
ORDERED that the time of Westchester County Correction Superior Officers Association and others to perfect their appeal from the order entered March 21, 2013, is enlarged until May 19, 2014; and it is further,
ORDERED that so much of the decision and order on motion of this Court dated February 11, 2014, as dismissed the appeal from the order entered June 20, 2011, is recalled and vacated, the appeal from the order entered June 20, 2011, is reinstated, and the time of County of Westchester and Westchester County Department of Correction to perfect their appeal from the order entered June 20, 2011, is enlarged until May 19, 2014; and it is further,
ORDERED that the application is denied without prejudice to making a motion for that relief.
