DECISION & ORDER ON MOTION

ant

On the Court's own motion, it is

ORDERED that the decision and order on motion of this Court dated February 27, 2014, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Motion by the respondents-appellants to dismiss an appeal from an order of the Supreme Court, Westchester County, entered October 3, 2013, on the ground that no appeal lies from so much of the order as denied reargument, and, in effect, that the appellant-respondent is not aggrieved by the remainder of the order.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and the appeal is dismissed, without costs or disbursements.

RIVERA, J.P., LOTT, ROMAN and HINDS-RADIX, JJ., concur.
