v Luigi Maddaloni, appellant.

(Index No. 8359-11)

DECISION & ORDER ON MOTION

Motion by Luigi Maddaloni to stay enforcement of two orders of the Supreme Court, Suffolk County, dated October 1, 2013, and December 3, 2013, respectively, and a decision of the same court dated February 6, 2014, pending hearing and determination of appeals therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal from the decision is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509); and it is further,

ORDERED that the branch of the motion which is to stay enforcement of the orders is denied; and is it further,

ORDERED that the motion is otherwise denied as academic.

SKELOS, J.P., DILLON, DICKERSON and AUSTIN, JJ., concur.
