Motion by respondent to dismiss an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered July 26, 2013.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that appellant's notice of appeal filed August 26, 2013, which contains an inaccurate description of the judgment appealed from, is deemed a valid notice of appeal from the judgment entered July 26, 2013 (see CPLR 5520 [c]); and it is further,

ORDERED that respondent's motion is denied.
