DECISION & ORDER ON MOTION y. enth, r;

Motion by Joseph B. Miller for reconsideration of an opinion and order of this Court dated August 21, 2013, and, upon reconsideration, to modify the commencement date of his disbarment.

Mr. Miller was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on September 14, 1972, under the name Joseph Barry Miller. By decision and order on application of this Court dated May 27, 2011, the application of the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to impose reciprocal discipline upon Mr. Miller based on disciplinary action taken against him by the Supreme Court of Florida was held in abeyance pending a hearing, upon his request, and the matter was referred to the Honorable Abraham Gerges, as Special Referee, to hear and report concerning the findings of the Florida tribunal and Mr. Miller's defenses to the imposition of reciprocal discipline. By opinion and order of this Court dated August 21, 2013, Mr. Miller was disbarred, effective immediately, based on an order of the Supreme Court of the State of Florida dated September 15, 2010, disbarring him in that state.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
