Motion by the respondent for leave to appeal to the Court of Appeals pursuant to CPLR 5602(b)(2) from an opinion and order of this Court dated December 18, 2013, which modified an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated February 1, 2011, which affirmed an order of the Civil Court of the City of New York, Kings County, dated March 6, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the following question is certified to the Court of Appeals: Was the opinion and order of this Court dated December 18, 2013, properly made?
