DECISION & ORDER ON MOTION

Motion by appellant for leave to reargue its prior motion for a stay pending the determination of appeals from orders of the Civil Court of the City of New York, Kings County, dated December 2, 2013 and January 21, 2014, respectively, which prior motion was determined by decision and order of this court dated February 21, 2014. Separate motion by respondent to vacate the temporary stay contained in the order to show cause signed by this court dated February 27, 2014 and to be restored to possession of the subject apartment.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that appellant's motion and respondent's motion are consolidated for purposes of disposition; and it is further,
ORDERED that appellant's motion and respondent's motion are denied as moot, as respondent is in possession of the subject premises.
