Ada Oparaji and Maurice Oparaji, Appellants, v Citibank, N.A. etc., Respondent.

Appeal from an order of the Civil Court of the City of New York, Queens County, entered December 10, 2013. The order denied appellants' motion for leave to renew their opposition to respondent's prior motion for summary judgment dismissing the complaint, which prior motion had been determined by an order of the same court entered July 17, 2012. By decision and order of this court dated April 9, 2014, the portion of the Civil Court's order entered July 17, 2012 that granted the branch of respondent's motion seeking summary judgment dismissing so much of the complaint as was asserted by appellant Maurice Oparaji was reversed and that branch of respondent's motion was denied.

On the court's own motion, it is

ORDERED that so much of the instant appeal as was taken by appellant Maurice Oparaji is dismissed as moot.
