Motion by the appellant on an appeal from an order of the Supreme Court, Westchester County, entered July 9, 2013, inter alia, to annul a certain determination made by letter dated January 21, 2010. Separate motion by the appellant, inter alia, for the Court to take judicial notice of certain Federal and State statutes, rules, or regulations cited by the parties.
Upon the papers filed in support of the motion, inter alia, to annul a certain determination made by letter dated January 21, 2010 and the papers filed in opposition thereto, and upon the papers filed in support of the motion, inter alia, for the Court to take judicial notice of certain Federal and State statutes, rules, or regulations cited by the parties and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion, inter alia, to annul the determination made by letter dated January 21, 2010, is denied; and it is further,
ORDERED that the motion, inter alia, for the Court to take judicial notice of certain Federal and State statutes, rules, or regulations cited by the parties is granted to the extent that the Court will take judicial notice of the Federal and State statutes, rules, or regulations cited by the parties, and the motion is otherwise denied.
