It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that tenant-respondent's motion to vacate the stay and dismiss the appeal is granted, unless landlord-appellant perfects its appeal by no later than the September 2014 term -
the filing deadline is July 9, 2014. In the event of landlord-appellant's failure to comply with the foregoing condition, tenant-respondent may move, on five days' notice, for an order vacating the stay and dismissing the appeal.
