Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, without costs, to the extent that respondent is enjoined from distributing the assets of the estate of Susan G. Vosilla, deceased, during the pendency of the appeal. This motion is granted upon the condition that appellant perfect the appeal on or before June 11, 2014. Respondent shall file and serve his brief on or before July 11, 2014. The reply brief, if any, shall be filed and served on or before July 21, 2014. The appeal is set down for the September 2014 term of this Court.
