2011-11032 In the Matter of Sandra L. Baker, petitione v Juniors Food Outlet, doing business as Western Beef, respondent. (Index No. 1969/09)
| DECISION & ORDER ON MOTION r, |
Application by the petitioner for leave to make a fourth motion, in effect, for leave to reargue her motion, inter alia, for leave to appeal to this Court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated May 23, 2011, which affirmed an order of the Civil Court of the City of New York, Kings County, entered August 18, 2010, which was determined by decision and order on motion of this Court dated January 20, 2012. After the determination of the motion, the petitioner made three motions, inter alia, for reargument. The motions were denied by decisions and orders on motion of this Court dated April 6, 2012, August 16, 2012, and December 5, 2012, respectively. The decision and order on motion dated December 5, 2012, also precluded the petitioner from making further motions without prior leave of this Court. Thereafter, prior to the instant application, the petitioner made 12 applications for leave to make a fourth motion for leave to reargue, each of which has been denied.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is denied; and it is further,
ORDERED that on the Court's own motion, the petitioner is enjoined from making any further motions or applications in connection with the above-entitled proceeding.
BALKIN, J.P., CHAMBERS, COHEN and DUFFY, JJ., concur.
