The People of the State of New York, Respondent, v Julian S. Pellecier, Appellant.

Motion by appellant for an enlargement of time to perfect an appeal from a judgment of conviction of the Justice Court of the Village of Southampton, Suffolk County, rendered January 10, 2011, and to compel the Justice Court to file the record on appeal with this court.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected expeditiously; and it is further,

ORDERED that the branch of the motion seeking to compel the Justice Court to file the record on appeal with this court is denied, as portions of the record and transcripts are missing and appellant has not moved in the Justice Court to reconstruct them.
