Motion by the appellant to enlarge the record on an appeal from a judgment of the County Court, Dutchess County, rendered August 28, 2009, to include excerpts of the transcript of the grand jury testimony.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the appellant shall file the subject excerpts of the grand jury testimony as an exhibit, under seal, in the office of the Clerk of this Court, at the time that he files his brief, for in camera review by the panel of Justices assigned to hear the appeal, and the exhibit containing the subject grand jury testimony shall remain sealed upon filing
