| DECISION & ORDER ON MOTION |
Application by the respondents to substitute Victor A. Kovner, as executor of the estate of Arthur Ortenberg, for the deceased respondent Arthur Ortenberg, and to amend the caption accordingly, on an appeal from an order and judgment (one paper) of the Supreme Court, Suffolk County, dated April 1, 2013.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, Victor A. Kovner, as executor of the estate of Arthur Ortenberg, is substituted for the deceased respondent Arthur Ortenberg, and the caption is amended accordingly; and it is further,
ORDERED that on the Court's own motion, the appellants' time to serve and file a reply brief is enlarged until May 30, 2014, and the reply brief must be served and filed on or before that date.
