DECISION & ORDER ON MOTION

Motion by Abraham Alayoff for leave to appeal to this Court from an order to show cause of the Supreme Court, Queens County, dated April 1, 2014, to stay enforcement of a temporary restraining order contained in the order to show cause, pending hearing and determination of the appeal, and for an award of costs and to impose a sanction upon Shereeann Alayoff.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal to this Court from the order to show cause dated April 1, 2014, is granted; and it is further,

ORDERED that the branch of the motion which is to stay enforcement of the temporary restraining order is granted, and enforcement of the temporary restraining order contained in the order to show cause dated April 1, 2014, is stayed pending either hearing and determination of the appeal from the order to show cause or determination by the Supreme Court, Queens County, of the motion initiated by the order to show cause, whichever occurs first; and it is further,

ORDERED that the motion is otherwise denied.
