Motion by the appellant to recall and vacate a decision and order on motion of this Court dated October 17, 2013, which dismissed an appeal from an order of the Family Court, Suffolk County, dated March 25, 2013, for failure to comply with the scheduling order dated April 23, 2013, to reinstate the appeal, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
