2014-03495 Jessica Traiman, respondent, v United Stat Life Insurance Company in City of New Y defendant, Vivian Traiman, et al., appellan (Index No. 5080/12)
| DECISION & ORDER ON MOTION es ork, ts. |
Motion by the appellants to stay all proceedings in the above-entitled action, pending hearing and determination of an appeal from an order of the Supreme Court, Nassau County, dated February 26, 2014.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal from so much of the order dated February 26, 2014, as referred for a hearing the branch of the respondent's motion which is to disqualify the appellants' counsel is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from so much of an order as directs a hearing to aid in the disposition of a motion (see Bagdy v Progresso Foods Corp., 86 AD2d 589) and we decline to grant leave to appeal; and it is further,
ORDERED that the motion is denied.
HALL, J.P., ROMAN, DUFFY and LASALLE, JJ., concur.
