On the Court's own motion, it is

ORDERED that the decision and order on motion dated May 15, 2014, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Separate appeals by Frances C. and Raymond S. from an order of the Family Court, Westchester County, dated January 23, 2014. The respondent-appellant Frances C. was granted poor person relief on April 29, 2014, and the following named attorney was assigned to prosecute the appeal on behalf of Frances C.:

On the Court's own motion, it is

ORDERED that counsel assigned to prosecute the appeal on behalf of Frances C. is relieved of the assignment and is directed to turn over all papers in the matter to new counsel herein assigned; and it is further,

ORDERED that pursuant to Family Court Act § 1120, the following named attorney is assigned as new counsel to prosecute the appeal on behalf of Frances C.:

and it is further,

ORDERED that assigned counsel shall promptly attempt to contact the respondent-appellant Frances C. at the address provided by the Court, and on or before June 4, 2014, shall notify the Case Manager assigned to the appeal, in writing, that she has done so and that either

(1) Frances C. is interested in prosecuting her appeal, or

(2) Frances C. is not interested in prosecuting her appeal, or that she has been unable to contact Frances C., and wishes to be relieved of the assignment; and it is further,

ORDERED that assigned counsel for Frances C. shall prosecute the appeal expeditiously in accordance with any scheduling order or orders issued pursuant to § 670.4(a) of the rules of this Court (22 NYCRR 670.4[a]); and it is further,

ORDERED that upon a determination that the respondent-appellant Frances C. is interested in proceeding with her appeal, counsel for Frances C. is directed to serve copies of this decision and order on motion and the order on certification of this Court dated April 29, 2014, upon the clerk of the court from which the appeals are taken.
