Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of Supreme Court, Monroe County rendered March 7, 2014,

Now, upon reading and filing the affidavit of Donte Twillie sworn to April 14, 2014, the notice of motion with proof of service thereof, the statement of Kevin K. McKain, Esq. dated April 24, 2014, the statement of Stephen X. O'Brien, Esq. dated May 6, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal served upon the Monroe County District Attorney on April 12, 2014 and filed at the Monroe County Clerk's Office on April 1, 2014 is hereby deemed timely filed and served, and

It is further ORDERED that said notice of appeal shall be treated as valid as to the judgment of Supreme Court, Monroe County rendered March 7, 2014 for indictment 2012-0911 pursuant to CPL 460.10(6).
