Application by the appellants pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect appeals from an order of the Supreme Court, Nassau County, dated July 10, 2013, and an order of the Supreme Court, Suffolk County, dated August 9, 2013, and, in effect, to consolidate those appeals with appeals from an order of the Supreme Court, Suffolk County, dated December 9, 2013, and an order and judgment (one paper) of the same Court dated October 11, 2013.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion the the appeal from the order dated August 9, 2013 (Appellate Division Docket No. 2013-10333), is dismissed, without costs or disbursements, as that order is not appealable as of right (see CPLR 5701[b][1]), and we decline to grant leave to appeal; and it is further,
ORDERED that the branch of the application which is to enlarge the time to perfect the appeal from the order dated July 10, 2013, is granted, the appellants' time to perfect that appeal is enlarged until July 15, 2014, and the record or appendix on the appeal and the appellants' brief must be served and filed on or before that date; and it is further,
ORDERED that the application is otherwise denied as academic; and it is further,
ORDERED that on the Court's own motion, the appeals are consolidated and the joint record or appendix on the appeals and the appellants' brief must be served and filed on or before July 15, 2014, and the parties shall file 10 copies of the record or appendix and their respective briefs.
