| DECISION & ORDER ON MOTION , |
Motion by the appellants to recall and vacate a decision and order on application of this Court dated October 28, 2013, that withdrew appeals from two orders of the Supreme Court, Orange County, both dated July 20, 2012, to reinstate the appeal by Moinuddin Ahmed, and to deem only the appeal by Rose Aumick, Bon Secours Community Hospital, and Bon Secours Charity Health System to be withdrawn.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the decision and order on application of this Court dated October 28, 2013 is recalled and vacated, the appeal by Moinuddin Ahmed (Appellate Division Docket No. 2012-08804) is reinstated and the appeal by Rose Aumick, Bon Secours Community Hospital, and Bon Secours Charity Health System (Appellate Division Docket No. 2012-08837) is marked withdrawn, without costs or disbursements.
