Respondent-appellant having moved for an extension of time to perfect the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on July 12, 2013 (CAF 13-01442), and the attorney for the child having cross-moved to dismiss the appeal,
Now, upon reading and filing the affirmation of Brett D. Tokarczyk, Esq., dated April 29, 2014, the affirmation of Jennifer M. Lorenz, Esq., dated May 8, 2014, and the notices of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the cross-motion to dismiss the appeal is denied with leave to renew in a responsive brief, and
It is further ORDERED that the appeal is hereby consolidated with the appeal taken herein from an order of the Family Court, Erie County, entered April 15, 2014 (CAF 14-00918), and
It is further ORDERED that the motion for an extension of time to perfect is granted, and respondent-appellant shall file the original and ten copies of the stipulated or settled record and ten briefs on the consolidated appeals, together with proof of service, on or before July 28, 2014, and in the event of failure to so perfect the appeals are hereby dismissed without further order.
