Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Kings County, dated December 6, 2013, on the ground that this Court lacks subject matter jurisdiction, for an award of costs and an attorney's fee, to deny the relief requested in a motion made by the appellants, or to direct the appellants to post a bond in the sum of $500,000 as a condition to granting the relief requested by the appellants in their motion.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are to dismiss the appeal and for an award of costs and an attorney's fee are denied; and it is further,
ORDERED that the motion is otherwise denied as academic as the appellants withdrew their motion.
