| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from a judgment of the County Court, Suffolk County, rendered January 10, 2012, to be provided with "[d]ocuments, [r]ecords, [t]he [t]rue [b]ill of [p]articulars, and all [a]ccusatory [i]nstruments that [were] used in preparing, prosecut[ing], and convict[ing]" him, and to be furnished with transcripts of all proceedings which occurred in the above-entitled matter from August 18, 2010, until January 10, 2012, including the grand jury proceedings.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is to be furnished with a transcript of the grand jury proceedings is granted to the extent that, on or before July 3, 2014, the District Attorney shall file a transcript of the grand jury proceedings, under seal, with the Clerk of this Court, for in camera review by the panel of Justices assigned to hear the appeal, and those minutes shall remain sealed upon delivery; and it is further,
ORDERED that the branch of the motion which is to be furnished with the transcripts of the proceedings of any pretrial hearings, of the plea of guilty or of the trial, and of the imposition of sentence in this action is denied as unnecessary as this Court previously directed that those transcripts be delivered to the appellant by decision and order on motion of this Court dated June 6, 2013; and it is further,
ORDERED that the branch of the motion which is to be provided with "[d]ocuments, [r]ecords, [t]he [t]rue [b]ill of [p]articulars, and all [a]ccusatory [i]nstruments that [were] used in preparing, prosecut[ing], and convict[ing]" him is granted to the extent that those documents are part of the original record on file with the Clerk of this Court; and it is further,
ORDERED that the motion is otherwise denied.
