The People, etc., respondent,

v Jerrod Bailey, appellant.

(Ind. No. 8569/00)

DECISION & ORDER ON MOTION

Appeal by the defendant from a judgment of the Supreme Court, Kings County, rendered March 19, 2001. By order to show cause dated March 28, 2014, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the notice of appeal is untimely and the time to seek an extension of time to file a notice of appeal has expired.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed (see CPL 460.30).

SKELOS, J.P., CHAMBERS, DUFFY and LASALLE, JJ., concur.
