Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from a decree of the Surrogate's Court, Suffolk County, dated December 14, 2012. Separate application by Gregory W. Fotiades, Jr., as administrator of the estate of Gregory W. Fotiades, to be substituted for the deceased respondent Gregory W. Fotiades, and to amend the caption accordingly.

Upon the papers filed in support of the application, and the papers filed in relation thereto, and upon the papers filed in support of the separate application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted, the appellant's time to perfect the appeal is enlarged until August 5, 2014, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,

ORDERED that the separate application is granted, and Gregory W. Fotiades, Jr., as administrator of the estate of Gregory W. Fotiades, is substituted for the deceased respondent Gregory W. Fotiades, and the caption is amended accordingly.
