Motion by the respondent Abraham Weisel, to dismiss an appeal from an order of the Supreme Court, Kings County, dated December 18, 2013, insofar as taken against him as untimely taken. Application by the respondent BSD-M Realty, LLC, to dismiss the appeal insofar as taken against it as untimely taken.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and the appeal is dismissed insofar as taken against the respondent Abraham Weisel, without costs or disbursements (see CPLR 5513[a]); and it is further,
ORDERED that the application is denied without prejudice to making a motion.
