Respondent Mildred Perea having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on April 12, 2013,

Now, upon reading and filing the affidavit of Mildred Perea, sworn to April 28, 2014, the notice of motion with proof of service thereof, and the affirmation of Sheila Sullivan Dickinson, Esq., dated May 16, 2014, and due deliberation having been had thereon,

It is hereby ORDERED, on the Court's own motion, that the order of this Court entered June 4, 2014, is vacated, and

It is further ORDERED that the motion is dismissed on the ground that the appeal is deemed abandoned and dismissed (see 22 NYCRR 1000.12 [b]).
