DECISION & ORDER ON MOTION

Motion by appellant pro se for leave to reargue an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered September 30, 2010, which was determined by decision and order of this court dated June 4, 2013, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court. Separate motion by appellant pro se for leave to prosecute the reargument/leave to appeal motion as a poor person and for the assignment of counsel. Separate motion by appellant pro se, in effect, for leave to serve and file amended papers in support of the reargument/leave to appeal motion.
Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is
ORDERED, on the court's own motion, that appellant's motions are consolidated for purposes of disposition; and it is further,
ORDERED that appellant's motion, in effect, for leave to serve and file amended papers in support of the reargument/leave to appeal motion is granted and the amended papers are deemed timely served and filed; and it is further,
ORDERED that appellant's motions for leave to reargue or, in the alternative, to appeal to the Appellate Division, and for poor person relief are denied.
