DECISION & ORDER ON MOTION

Motion by respondent on an appeal from an order of the Civil Court of the City of New York, Kings County, dated November 14, 2013, to vacate a stipulation of settlement dated February 10, 2014. The stipulation provided, among other things, for the withdrawal of the appeal and of appellant's order to show cause returnable February 13, 2014, in return for specified consideration.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED, on the court's own motion, that the appeal and the order to show cause returnable February 13, 2014 are marked withdrawn.
