DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Anthony Watson, Appellant.

Motion by appellant on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered June 16, 2011, in effect, to recall and vacate so much of a decision and order on motion of this court dated December 22, 2011 as granted the branch of appellant's prior motion seeking to treat the notice of appeal from the aforesaid judgment of conviction as a valid notice of appeal from a judgment of conviction purportedly rendered July 19, 2011, to withdraw that branch of their prior motion, and to amend this court's December 22, 2011 decision and order on motion to reflect the correct date of the judgment of conviction.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, so much of this court's December 22, 2011 decision and order on motion as granted the branch of appellant's prior motion seeking to treat the notice of appeal from the judgment of conviction rendered June 16, 2011 as a valid notice of appeal from a judgment of conviction purportedly rendered July 19, 2011 is recalled and vacated, that branch of appellant's prior motion is marked withdrawn, and this court's December 22, 2011 decision and order on motion is amended to reflect that the judgment of conviction was rendered on June 16, 2011.
